Resolving complex equal opportunity, bullying and misconduct cases

Program overview

Conducting an investigation into an EO, bullying or misconduct case is a relatively straightforward process… in theory. However, factors such as absent respondents, reluctant witnesses, conflicting statements and organisational politics all contribute to making cases more complex than they initially seem.

This program will introduce a simple approach to investigating and resolving EO, bullying or misconduct complaints, with a focus on the more sensitive, political and complex cases that are particularly disruptive to business, challenging to resolve and personally taxing for you as the investigator.

In addition to developing an understanding of the legal framework, in this program you will learn how to anticipate and manage the complexities that may stall the process or prevent the investigation from being concluded thoroughly and expeditiously.

  • planning an investigation effectively and in compliance with the law and company policy and procedures
  • anticipating issues that might make the investigation more complex and take steps to mitigate against these
  • conducting constructive interviews in order to determine the facts and test the validity of allegations
  • managing the people involved in the issue, as well as the organisational politics
  • constructing a thorough and well-structured report of the investigation
  • assessing information collected particularly when the evidence is conflicting
  • explaining the importance of maintaining confidentiality and the limits of what can be kept confidential, and
  • influencing key stakeholders to support the findings and recommendations.
